PROMOTIONAL GENERAL TERMS & CONDITIONS
INTRODUCTION & THE PROMOTION
- These Terms & Conditions are to be read in conjunction with the Promotion Details above. Any capitalised terms used in these Terms & Conditions have the meaning set out in the Promotion Details above.
- These Terms & Conditions apply to the Promotion which is conducted by the Promoter. By participating in the Promotion, you agree to be bound by these Terms & Conditions, which constitutes as a legally binding agreement between you and the Promoter.
- Where applicable, the Permit Numbers as set out in Item 4 of the Promotion Details apply to the Promotion.
All decisions made by the Promoter with respect to any aspect of the Promotion are final, and no correspondence will be entered into with you.
ENTRY
- All entries in the Promotion must comply with these Terms & Conditions (Entry) and each Entry has an equal chance at winning the Prize.
- Your Entry must be submitted:
- during the Promotional Period set out in Item 11 of the Promotion Details;
- in accordance with the Entry Requirements set out in Item 6 of the Promotion Details; and
- in accordance with the Entry Conditions set out in Item 7 of the Promotion Details.
- Your Entry will be deemed to be received only when received by the Promoter.
- If you submit an Entry, you warrant that you are an Eligible Entrant set out in Item 5 of the Promotion Details and that if you are not, you may be disqualified from the Promotion. The Promoter reserves all rights with respect to such breach.
- You are solely responsible for your Entry, including any costs associated with entering the Promotion and/or network connectivity.
- Where applicable, except for your personal information, the Promoter is the sole owner of all intellectual property in connection with the Promotion (including your Entry).
PRIZE
- The Prize must be accepted as offered and claimed in accordance with Item 10 of the Promotion Details, otherwise the Prize shall be forfeited by the Winner. The Promoter will not be liable for any unclaimed Prize under this Clause and the Promoter is under no obligation to offer an additional or substitute Prize to that Winner.
- The Prize may be subject to any additional terms and conditions as determined by the relevant supplier of the Prize and/or the Promoter.
- Unless otherwise stated, the Prize cannot be resold, transferred, exchanged, redeemed for cash for any reason; or used for any advertising, promoting or other commercial purposes.
- The Total Prize Value set out in Item 3 of the Promotion Details is correct as at the date of preparing these Terms & Conditions and shall include any applicable GST.
- The Promoter does not accept any responsibility for a variation in the Prize. If any Prize (or part of) is unavailable, the Promoter reserves the right to substitute the Prize with a prize of equal or greater value and you agree to accept such substitution in writing, subject to any applicable regulation.
- To the fullest extent permitted, the Promoter will not be held responsible for the failure to provide the Winner with the Prize or substitute Prize under Clause 3.5.
- Where applicable, the Promotor is not responsible for any dispute between a Winner and any person with whom a Winner chooses to share the Prize.
- The Promoter is not responsible for any tax implications and the Winner is solely responsible for the payment of all taxes (if any) in connection with the Prize. It is the Winner’s sole responsibility to seek independent financial advice as they require.
DRAW & RESERVE WINNERS
- The Promoter will conduct the Prize Draw in accordance with Item 8 of the Promotion Details, and the Winner shall be selected at random.
- The Winner will be notified in accordance with Item 9 of the Promotion Details.
- The Promoter may draw additional reserve Entry Winners in the Draw and record them in order (Reserve Winner).
- In the event that:
- a Winner is deemed ineligible for any reason;
- after the Promoter makes reasonable efforts, the Winner cannot be identified or does not come forward to claim the prize within three (3) months of being notified; or
- where a Winner forfeits a Prize under Clause 3.1, the Prize may be awarded to the Reserve Winner.
PARTICIPANT CONDUCT & BREACH
You must not:
- tamper with the Promotion in any way or at any stage;
- engage in any conduct that may jeopardise the fair and proper conduct of the Promotion, including using automatically generated entries or aliases;
- act in a disruptive, annoying, threatening, abusive or harassing manner; or
- do anything that may diminish the good name or reputation of the Promoter or any of its related partners, suppliers, entities and/or of the agencies or companies associated with this Promotion.
- The Promoter reserves the right, at any time, to require documentation from you to verify the validity of your Entry (including your name, age and place of residence).
- Any breach of or failure by you to comply with these Terms & Conditions or those imposed by the Promoter’s partners may result in the Prize being withdrawn from you or you being disqualified from the Promotion, without further liability for the Promoter and/or its partners. The Promoter and/or its partners reserve all rights with respect to any breach of these Terms & Conditions.
PERSONAL INFORMATION AND PROMOTIONS & MEDIA
- Your personal information is directly collected by the Promoter in connection with the Promotion and is used to:
- Conduct the Promotion, which may include supplying your personal information to the Promoter’s partners and/or suppliers of the Prize;
- Provide you with the Promoter’s subscription updates, which you can unsubscribe from at any time; and
- Promote the Promoter and/or the Promotion in accordance with Clause 6.2.
- The Winner agrees to participate in promotional activity and consents to the use of the Winner’s name and image in connection with the Promotion, without further remuneration.
- By entering into this Promotion, you agree that the Promoter may store and use your personal information in accordance with its Privacy Policy found on its Website (Privacy Policy).
- Please visit the Privacy Policy for further information regarding how to seek access or correction of your personal information, or to make a complaint with respect to your privacy.
LIMITATION OF LIABILITY
- To the fullest extent permitted by law, the Promoter is not liable for any personal injury or death, losses or damages of any kind to persons or property resulting in whole or in part, directly or indirectly, from the participation in the Promotion or from the acceptance, possession, misuse or use of any Prize.
- Without limiting Clause 7.1, the Promoter and its partners, suppliers of the Prize, or associated companies is not liable for any incorrect or ineligible submission Entries, failure to claim a Prize, damage or delay in delivery of Prizes, or failure to receive correspondence.
If this Promotion cannot be conducted for any reason beyond the Promoter’s control (including but not limited to technical issues or failure or tampering and fraud), the Promoter may end, amend, suspend or cancel the Promotion or disqualify affected Entries, subject to any necessary approval by the relevant regulatory body (if any).
GENERAL
- Nothing in these Terms & Conditions restricts, excludes or modifies any consumer rights under any statute including the Competition and Consumer Act 2010 (Cth).
- By entering into the Promotion, you accept that any dispute with respect to the Promotion and/or these Terms & Conditions shall be subject to the jurisdiction of the Victorian Courts in Australia.
REFUNDS, RETURNS & EXCHANGES
- By purchasing a membership or a one-time package for the Runnit platform, you are providing support to the Runnit brand. It is important to note that memberships and one-time packages purchased during a promotional period or giveaway are non-refundable.
- Our goods and services come with guarantees that cannot be excluded under Australian Consumer Law. For major failures, you are entitled to
- cancel your service contract with us; and
- a refund for the unused portion or compensation for its reduced value.
- You are also entitled to choose a refund or replacement for major failures with goods.
If a failure with the goods or service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done, you are entitled to a refund for the goods and to cancel the contract for the service. Refunds or rectifications cannot be given for reasons such as change of mind or failure to not understand properly.
ACCOUNTS
- To use certain portions of the Website and Service, you will be directed to register on the Website and create a user profile or account (Account). Eligibility is limited to persons equal to or over the age of 18.
- As part of the registration process, you may be asked to submit your name, address, email address and/or similar information and to select a password. You agree that all information you provide to Runnit for purposes of creating an account (Registration Information) will be true, accurate, current, and complete and your failure to provide such information shall constitute a breach of these terms and conditions and may result in the immediate termination of your Account. You shall (i) promptly update your Registration Information to keep it true, accurate, current, and complete; and (ii) maintain the confidentiality of your password.
- In creating an Account, you shall not (a) select or use the email address or username of another person with the intent to impersonate that person, (b) use a name subject to the rights of any other person without authorization, (c) use an email address or username that is profane, offensive, or otherwise inappropriate or (d) allow any other party to use your Account and/or password except as set forth herein.
- You may not share or transfer any Account. You may not disclose your password to anyone. You agree to immediately notify Runnit by sending an email to [email protected] of any known or suspected unauthorized use(s) of your Account or any known or suspected breach of security, including loss, theft or unauthorized disclosure of your password. You understand and agree that you shall be liable for all activities that occur under any Account created for your use, even if such activities were not committed by you.
- Runnit is not responsible for any loss or damage arising from your failure to maintain the confidentiality of your password.
- Runnit employees, directors, managers and their respective immediate family members (i.e., parents, spouses, domestic partners, siblings and children) or any other person residing in the same household as an Runnit employee, director or manager may not win the offered giveaways.
TERMINATION OF ACCOUNT
- You understand and agree that you have no ownership rights in your Account and Runnit may stop offering the Service at any time. Further, Runnit may cancel your Account, delete all of your Registration Information and any other information you have provided through the Website (collectively, User Content) associated with your Account at any time, without notice, for any reason or no reason including, without limitation, your violation of these terms and conditions. Runnit will not be liable for any damages or loss resulting from the removal of any User Content from the Website and/or the Service.
- To cancel your account, simply contact [email protected] and request cancellation. Once the request has been made, a specific cancellation link will be sent to you within 72 hours. You will need to click on this link and follow the prompts to complete the cancellation process.
ONE-OFF MEMBERSHIP PACKAGES & MEMBERSHIPS
- Customers have a choice of selecting a Once off Package membership or becoming a monthly Member to access the Runnit rewards platform.
TERMINATION OF MEMBERSHIP
- Upon cancelling your loyalty membership which must be done via email to [email protected] and then following the link provided, you will remove all future payments and remove the bonus accumulated entries from all future promotional giveaways.
- To be removed from our mailing or text lists, please use the associated links as they are sent via third parties. Terminating your loyalty membership alone will not remove you from these lists.
- If your account fails to pay, there will be 4 automatic attempts made to bill it. The system will attempt to bill your account every 5 days (20-day grace period) from the initial payment failure. On the 4th and final attempt, if there are insufficient funds, your subscription will be terminated, and your loyalty streak will be lost.
- If you cancel your subscription, Stripe does not allow for its reactivation, and all accumulated history for that subscription will be lost. To continue your subscription, please follow the instructions in the notification emails provided or log in to the member’s dashboard and update your banking details.
- If your account is cancelled, you can sync up the entry history by creating a new subscription within 30 days of the cancellation. Only the most recent active subscription will be synced up, and if there are multiple cancellations, the previous entry history will not be included in the accumulation of entries moving forward since the cancellation date is beyond 30 days from the current active subscription.
- Please note that the system only allows for 4 attempts, which includes any manual attempts made by the user to charge the account.
HYPERLINKS
- The Website may contain links to websites operated by other parties. Runnit provides these links to other websites as a convenience and use of these sites is at your own risk. The linked sites are not under the control of Runnit, and Runnit is not responsible for the content available on the other sites. Such links do not imply Runnit endorsement of information or material on any other site and Runnit disclaims all liability with regard to your access to and use of such linked websites.
- You may not place a link to the Website on another website without Runnit’s prior written consent and, without limiting the foregoing, you must adhere to Runnit inking policy as follows: (i) the appearance, position and other aspects of the link may not be such as to damage or dilute the goodwill associated with Runnit and/or its licensors’ names and trademarks, (ii) the appearance, position and other attributes of the link may not create the false appearance that your organization or entity is sponsored by, affiliated with, or associated with Runnit (iii) when selected by a user, the link must display the Website on full-screen and not within a frame on the linking site, and (iv) Runnit reserves the right to revoke its consent to the link at any time and in its sole discretion.
THIRD-PARTY PRODUCTS, SERVICES + DISCOUNTS FROM OUR PARTNERS.
- Third party services, content, information, and products may be made available by Runnit on or through the Website. Third Party Products, services and discounts are provided solely for the benefit of our paid members and Runnit makes no representations or warranties regarding any Third-Party Products, services and discounts and takes no responsibility and assumes no liability for any Third-Party Products, services or discounts. Third Party Products, services and discounts are subject to the applicable terms and policies of the third parties that offer them.
WEBSITE TERMS & CONDITIONS
1. DEFINITIONS
In these Terms and Conditions, unless the context otherwise requires:
“Seller” means RUNNIT (ABN 29 819 024 911).
“Customer” means the person(s) (including a body corporate) who orders the Products from the Seller (and including any person acting on behalf and with the authority of the Customer);
“Price” means the price payable by the Customer to the Seller for the Products;
“Products” means goods or services supplied by the Seller to the Customer (and where the context so permits shall include any supply of services such as the provision of advice or recommendations) and are as described on the invoices, quotation, work authorisation or any other forms provided by the Seller to the Customer;
“Terms and Conditions” means the terms and conditions of sale set out in this document.
2. ACCEPTANCE OF TERMS
The Customer accepts and agrees to be bound by these Terms and Conditions by submitting an order to the Seller for the supply of Products and/or the by accepting Products supplied by the Seller.
3. RETURNS/REFUNDS
The Seller reserves the right to accept any cancellation of Customer’s purchased entry packages. In order to be considered for a refund, the Customer must request a cancellation/refund. Customer’s can not receive a refund if the competition entered has passed, and a winner has been announced. The Seller will notify the Customer of the outcome of the request and refund any funds if applicable. The Seller’s full returns and refunds policy can be viewed here.
4. INTELLECTUAL PROPERTY
All content, information, graphics and website design are the property of the Seller and are not to be used or reproduced without the consent of the Seller.
5. LIMITATION OF LIABILITY
The Customer acknowledges that the Products are bought relying solely upon the Customer’s skill and judgement. Any advice, recommendations, information, assistance or service provided by the Seller to the Customer in relation to the Products sold or their use or application is provided in good faith and the Seller believes such advice to be appropriate and reliable. The Seller will not be held liable a Product that is not cared for correctly or where the care instructions have not followed. Any such advice in relation to any Products sold by the Seller is provided, however, without liability or responsibility on the part of the Seller. To the extent required under common law and any applicable legislation, the Seller acknowledges that liability may attach in relation to (and be limited solely to) personal injury or property damage arising out of any negligence on behalf of the Seller in provision of the Products. In the event of any breach of these Terms & Conditions by the Seller, the remedies of the Customer shall be limited to damages which under no circumstances shall exceed the Price of the Products. The Seller shall be under no liability whatever to the Customer for any indirect loss and/or expense (including loss of profit) suffered by the Customer.
6. SEVERANCE
Nothing in these Terms and Conditions is intended to have the effect of contracting out of any applicable provisions of any state or federal legislation (including but not limited to the Australian Consumer Law), except to the extent permitted by such legislation where applicable. If any provision of these Terms and Conditions shall be invalid, void, illegal or unenforceable the validity, existence, legality and enforceability of the remaining provisions shall not be affected, prejudiced or impaired.
7. JURISDICTION
These Terms and Conditions shall be governed by the laws of Victoria. The Seller and the Customer irrevocably submit to the exclusive jurisdiction of the courts of Victoria.
8. WAIVER
The failure by the Seller to enforce any provision of these Terms and Conditions shall not be treated as a waiver of that provision, nor shall it affect the Seller’s right to subsequently enforce that provision.
9. INCONSISTENCY
Where these Terms and Conditions are inconsistent with a written quotation, work authorisation or other form provided by the Seller to the Customer, the provisions of that written quotation, work authorisation or other form will prevail to the extent of the inconsistency.
10. WHOLE AGREEMENT
These Terms and Conditions (together with the Application and any written quotation, work authorisation or other form provided by the Seller to the Customer) form the entire agreement between the Seller and the Customer. All conversations, representations and statements not confirmed in writing by the Seller are expressly excluded and shall not be deemed to be part of any quotation, invoice, order, agreement or contract, or to have induced the order of the Products, or to have any legal effect whatsoever.
11. AMENDMENT
These Terms and Conditions supersede all previous terms and conditions of trade of the Seller. The Seller reserves the right to review these Terms and Conditions at any time. If, following any such review, there is to be any change to these Terms and Conditions, then that change will take effect from the date on which the Seller notifies the Customer of such change. The Customer’s acceptance of any amendments to these Terms and Conditions will be evidenced by the Customer’s acknowledgement in writing or by the Customer submitting a further order of Products to the Seller after receiving notification of the amendments without the need for the Customer to provide any other formal notification of its acceptance to Seller.

MEMBERSHIP TERMS AND CONDITIONS
- Runnit (ABN 29 819 024 911) (Runnit, we, us or our) operates the Runnit platform, providing one-off and loyalty memberships to which these terms and conditions apply.
- You must be 18 years of age or over to sign up to an Runnit membership.
- Membership of Runnit is subject to the terms and conditions that apply to the use of the Runnit website. These terms and conditions are a binding agreement between us and each member of the Runnit platform. By signing up to an Runnit membership, you agree to these terms and conditions and our Privacy Policy. Please read these terms and conditions and Privacy Policy carefully before you purchase an Runnit membership. For more information regarding our use of your personal information and opt-out procedures, refer to our Privacy Policy.
ONE-OFF MEMBERSHIPS
- One-off memberships are the perfect way to access our services and the Runnit platform for a shorter period to suit your needs.
There are five types of one-off memberships, as follows:

2. You may purchase multiple one-off memberships, which will accumulate and combine your days of access to the Runnit partners database.
3. You may purchase both loyalty and one-off memberships at the same time, however the access days from the one-off membership will not be used until after your loyalty membership is cancelled or terminated.
ENTRIES INTO PROMOTIONAL DRAWS
- Entries into promotional draws are otherwise subject to the terms and conditions associated with the relevant promotion, which should be read in conjunction with these membership terms and conditions.
LOYALTY MEMBERSHIPS
- Loyalty memberships are an on-going subscription to the Runnit platform, which are direct debited until cancelled by you or terminated by us in accordance with these terms and conditions.
- There are three types of loyalty memberships, as follows:

ENTRIES INTO PROMOTIONAL DRAWS
- Loyalty members accumulate entry/ies for each continuous month that they hold a membership. Entries are generated based on your current loyalty membership level. This means if you have held a loyalty membership for six months and have changed your membership status from one membership level to another during that time, the total number of entries you receive in a draw will be calculated in accordance with the membership level you hold at the time of the entries being generated for a specific giveaway and the tiers you have had previously.
- Loyalty membership entries into promotional draws are generated before the relevant promotion period commences.
- Entries into promotional draws are otherwise subject to the terms and conditions associated with the relevant promotion, which should be read in conjunction with these membership terms and conditions.
UPGRADE OR DOWNGRADE OF LOYALTY MEMBERSHIP
- You can request to upgrade or downgrade your loyalty membership at any time through you Runnit portal, however it will come into effect on your next billing cycle. No refund will be offered if you opt to downgrade your membership mid-billing cycle.
TERMINATION OF MEMBERSHIP
- You may cancel your membership at any time by emailing [email protected]. We will then provide you with a link where you will prompted with steps to cancel your membership.
- Once the cancellation process is complete, your membership will be cancelled instantly and you will be sent a confirmation email. No refund will be offered if you cancel your membership mid-billing cycle for any reason or if you do not complete the cancellation process before the payment comes out. This applies to both monthly and yearly memberships.
- Cancellation of your membership will not remove you from our marketing database. To remove yourself from our marketing database you must click the unsubscribe link in the promotional email or SMS message (as relevant) and follow the prompts.
- If you hold a loyalty membership and, for any reason, a direct debit for payment of your loyalty membership fails, we will attempt to debit your payment on four further occasions every five days over a 15 day period after the initial payment failure. If, after five attempts, we are unable to debit your loyalty membership payment, your loyalty membership and all membership benefits will be terminated.
CHANGE OF DETAILS
- You should notify us of any change of name, address, contact number, email address or billing information by updating your details online at runnit.com.au, or emailing us at [email protected].
- We will not be responsible for any failure by you to notify us of your change of details, which may result in you not obtaining the full benefit of your Runnit membership.
LIABILITY
- We do not exclude any rights and remedies in respect of goods or services under the Competition and Consumer Act (2010) which cannot be excluded, restricted or modified. However, the remainder of this clause will apply to the fullest extent permitted by law and we and our partners are not be liable (including in negligence) for any loss (including but not limited to indirect, special or consequential loss or loss of profits), expense, damage whatsoever which is suffered or for any personal injury, illness or death suffered or sustained in connection with Runnit membership, except for any liability which cannot be excluded by law.
GENERAL TERMS AND CONDITIONS
- For the purpose of these terms and conditions, mates rates means the discounted rates we have arranged with each of our partners and distributors. A full list of our partners is available at runnit.com.au.
- We are not responsible for any tax implications arising from you using the Runnit platform or receiving any benefit from it.
- We may exclude or suspend you from the Runnit platform or from receiving benefits from the Runnit platform if you:
- engage in conduct that may jeopardise the proper conduct of the Runnit platform;
- act in a disruptive, annoying, threatening, abusive or harassing manner;
- do anything that may diminish the good name or reputation of us, our partners or any of our related entities or contractors;
- breach any law in connection with the Runnit platform or your participation in our promotions; or
- behave in a way that we reasonably believe is otherwise inappropriate.
- You must not assign or attempt to assign any right or liability under these terms and conditions without our prior written consent.
- Any term of these terms and conditions that is expressed to survive, or by its nature survives, the termination or expiry of these terms and conditions will survive and continue in effect following such termination or expiry.
- All references to $ in these terms and conditions are in Australian dollars.
- We may, from time to time, amend these terms and conditions. The amended terms and conditions will apply from the time they are posted on the Runnit website or are otherwise notified to members. If you do not wish to accept any amendments to these terms and conditions, you may cancel your Runnit membership.
- We may cease offering memberships by notifying members on the Runnit website or otherwise, provided that we provide sufficient notice so that the termination does not cause unreasonable financial or other detriment to members.
- These terms and conditions are governed by the laws of Victoria, Australia.
